On Construction Domestic Energy Performance Certificates for Sale or Rental


There is much confusion around the requirements for either an RdSAP EPC (required for an existing building) or a SAP EPC (required for a new dwelling). The important date (in England at least, Scotland has different rules) is 6th April 2008. Any dwelling built prior to this date can be assessed using RdSAP, and this can be done by any domestic energy assessor.

If the building was completed after 6th April 2008 and has never had an EPC, it must have a SAP EPC first… Even if the property has been lived in, and years have passed. An RdSAP EPC isn't acceptable unless there has been a SAP EPC produced first. There are a couple of exceptions to these rules:

1. If the SAP data set (i.e. The full set of data used for building regulation compliance) is not available AND the evidence for its lack of availability has been provided, or

2. If the SAP data is available but the building has been altered in such a way that the data is no longer applicable AND the details of the alterations are unknown then the dwelling may be assessed using RdSAP (NB: Evidence that the dwelling has been altered and evidence for lack of building regulation approval for the alterations must be provided).

(It should also be noted that, as we are now more than 10 years on from the 6th April 2008, certificates are now expiring. As long as a new property DID have a SAP EPC created on completion, it is acceptable for all future EPCs to be produced using RdSAP, by a domestic energy assessor.)

Occasionally it is discovered that, while a dwelling may have been signed off by building control, the correct paperwork was never completed and the On Construction EPC was never lodged. Often, it is simply a matter of tracing back the person or company who provided the Part L calculations and asking them to lodge the certificate, however this may not be possible.
